1. Introduction and Acceptance

Welcome to RSVPMePls ("Platform", "Service", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the RSVPMePls platform, including our website, mobile applications, SMS services, and all related services.

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Service Description

RSVPMePls is an event management and RSVP platform that enables users to:

• Create and manage event invitation pages
• Collect and manage guest RSVPs
• Send SMS invitations and reminders to guests
• Track guest responses and event attendance
• Manage guest lists and contact information

3. Account Registration and Responsibilities

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

You must be at least 18 years of age to create an account and use our Service.

6. Data Privacy and Protection

6.1 Your Role as Data Controller

When you collect and process personal information from your guests (such as names, phone numbers, email addresses, and RSVP responses), you act as a "Personal Information Controller" under the Data Privacy Act of 2012. As such, you are responsible for:

• Obtaining proper consent before collecting personal information
• Informing data subjects of the purpose of data collection
• Ensuring the accuracy and security of collected data
• Respecting data subjects' rights to access, correct, and delete their information
• Not using collected data for purposes beyond event management without additional consent

6.2 Our Role as Data Processor

RSVPMePls acts as a "Personal Information Processor" when handling guest data on your behalf. We commit to:

• Processing personal information only as necessary to provide the Service
• Implementing appropriate technical and organizational security measures
• Not selling, renting, or sharing guest personal information with third parties for marketing purposes
• Deleting or anonymizing data upon account termination or as required by law

6.3 Data Retention

We retain your data for as long as your account is active or as needed to provide services. After account termination, we may retain certain data for legal compliance, dispute resolution, or legitimate business purposes as permitted by law.

6.4 Data Deletion

You may request deletion of your personal data at any time by contacting us at privacy@rsvpmepls.com. Upon receiving a valid deletion request, we will:

• Delete or anonymize your personal information within 30 days
• Remove your account and associated data from our active systems
• Retain only data required for legal compliance or legitimate business purposes

If you signed up using Facebook Login, you can also request data deletion through Facebook's data deletion process. We will automatically process deletion requests received from Facebook.

7. Payment Terms and SMS Credits

7.1 SMS Credits

SMS services are provided on a prepaid credit basis. You agree that:

• Credits must be purchased before sending SMS messages
• One credit equals one SMS message sent
• Credits are non-transferable and non-refundable except as required by law
• Unused credits may expire as specified at the time of purchase
• We reserve the right to modify credit pricing with reasonable notice

7.2 Refund Policy

All purchases are final. Refunds may be considered on a case-by-case basis for:

• Technical failures on our part that prevented message delivery
• Duplicate charges due to payment processing errors

Refunds will NOT be issued for credits forfeited due to account termination for Terms violations.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by RSVPMePls and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you upload to the platform (such as event images and descriptions). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DO NOT GUARANTEE THAT SMS MESSAGES WILL BE DELIVERED TO ALL RECIPIENTS
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• WE ARE NOT RESPONSIBLE FOR THE ACTIONS OF THIRD-PARTY TELECOMMUNICATIONS PROVIDERS

10. Indemnification

You agree to defend, indemnify, and hold harmless RSVPMePls, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including privacy or intellectual property rights
• Any claim that your use of SMS services caused damage to a third party
• Your violation of any applicable laws or regulations

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us at legal@rsvpmepls.com.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
